Hajbeh incorrectly marked his marital status as “single” instead of “married” on immigration paperwork in 1993. He was ordered to be deported, despite being acquitted of falsifying the document.
He continued to be imprisoned based on a 1999 conviction—made in absentia in Jordan—of plotting to bomb an American school. His co-defendants’ convictions were overturned. Hajbeh’s has not been because he has not returned to Jordan.
The judge ordered Hajbeh’s release because the U.S. government violated his constitutional rights.
